1. Scope of These Terms

These Terms apply to:

• Retail & B2B Buyers (domestic & export)

• Farmers, FPOs & Lease Partners

• Institutional Collaborators (NGOs, Startups, Researchers)

• Users of FARMOS™ platform and traceability systems

• Exporters, third-party logistic partners, and compliance officers

Any use of our digital tools, farming network, procurement or supply chain systems signifies full acceptance of these Terms.

2. Products & Services Overview

We offer products and services across the following verticals:

• Herbal powders, raw herbs, leaves, and dried extracts

• Fruits, vegetables, grains, and farm-based value-added goods

• Contract farming and collaborative cultivation programs

• Leased model farming on registered plots

• FARMOS™ software for traceability, planning, and data management

• Export-ready products with COA and trace-linked certification support

We reserve the right to modify or discontinue products, pricing, and service categories without prior notice.

3. Order Acceptance & Fulfillment

• Orders (retail/B2B/export) are accepted via website, email, WhatsApp, or signed contract.

• All orders are subject to availability, seasonality, and technical feasibility.

• Pricing is dynamic based on product category, order volume, and lab specifications.

• Payment Terms:

  • Retail: 100% advance

  • B2B: 50% advance / 50% before dispatch (unless otherwise agreed)

  • Export: 100% advance via bank transfer or L/C

• Dispatch Timeframes:

  • Herbal powders: 3–7 business days

  • Fresh produce: 1–3 days post-harvest

  • Export orders: 7–15 business days based on documentation

4. Contract Farming, FPO, and Land-Lease Engagements

• Every contract, FPO, or leased land agreement must be backed by written MOU/Agreement, which defines crop, acreage, pricing, input support, SOPs, and liabilities.

• We do not guarantee minimum yield or price unless explicitly agreed in writing.

• Farmer and FPOs are responsible for executing agreed practices unless input/control is fully provided by Sabar Farm.

• Breach of agronomic protocol or unauthorized resale leads to immediate disqualification and legal consequence.

5. Quality Assurance & Testing

• We operate under GMP, FSSAI, and ISO-certified practices.

• All products are subject to Batch-Wise Testing for:

  • Microbial load

  • Heavy metal residue

  • Moisture, ash value, extractives (as per product)

  • Mesh size, aroma, and potency

• COA (Certificate of Analysis) is available for B2B/export clients.

• Product acceptance is conditional on batch pass results. We do not ship failed material.

6. Returns, Cancellations, and Refunds

• Returns are not accepted for B2B, FPO, or export orders, except in case of genuine quality failure.

• Retail return window: 7 days from delivery (unopened, with photo/video proof).

• Refunds are subject to investigation and will be processed within 7–10 business days.

• Cancellations must be made within 24 hours of order; beyond that, they are not eligible for refund.

7. FARMOS™ Software Use

• FARMOS™ is our proprietary agri-tech solution built with IoT, Blockchain, and QR tracking.

• Any farmer, FPO, or buyer using FARMOS™ is responsible for:

  • Keeping login credentials confidential

  • Not manipulating or falsifying batch entries or reports

  • Reporting system bugs or data issues in good faith

• Access may be suspended in case of policy violation or misuse.

• FARMOS™ is governed under Indian IT Act compliance, and all data is securely stored on encrypted servers.

8. Intellectual Property & Content Use

• All content on our website/platform (text, videos, images, data, FARMOS™, batch codes, logos) is property of Sabar Farm Harvesting Care LLP.

• No content may be reused, copied, distributed, or modified without written approval.

• Trademarks such as Sabar Farm™, Vruksh Veda™, Twist Tingle™, and FARMOS™ are legally protected.

9. Legal Jurisdiction & Dispute Resolution

• All transactions and contracts are governed under Indian Contract Act, FSSAI Act, and relevant export laws.

• Any disputes shall be settled in the jurisdiction of Gujarat High Court, India.

• We recommend dispute mediation before legal escalation.

10. Limitation of Liability

• Sabar Farm is not liable for indirect damages arising from:

  • Delay due to natural calamities, logistics failure, strikes

  • Buyer misuse or misinterpretation of product use

  • Unapproved blending or transformation of product

• Maximum liability, if proven, will not exceed the value of the invoice amount.

11. Changes to Terms

We may update these terms to reflect changes in business, law, or platform features. Updates will be posted on the website. Your continued use of our services means you agree to the new terms.
